Terms of Service

These terms are the agreement between you and Vladyslav Stelmakh (“we”) about using Hooper. By using the app, with or without an account, you accept them. If you do not, do not use the app.

1. Who may use Hooper

You must be at least 16. You must give a real date of birth and accurate profile details. One account per person. Do not create an account for anybody else, and do not impersonate anyone.

2. Your account

You are responsible for what happens under your account. A guest account has no email attached, which means that if you lose the device you lose the account — we cannot recover it for you. Adding Sign in with Apple, Google or an email address to a guest account keeps everything you have earned.

3. Courts are public places

Hooper shows outdoor courts, most of them recorded by OpenStreetMap contributors. “Verifying” or claiming a court in the app gives you no rights over the physical court whatsoever. It makes you the caretaker of that court's page inside Hooper — you can add photos and details, and you can ban a player from the games organised there through the app. That is all it is. It does not make the court yours, it does not let you exclude anyone from the court itself, and it does not override whoever actually owns or manages the site.

Anyone signed in may schedule a game at any court, including one they did not claim. That is deliberate: a public court belongs to whoever turns up.

You are responsible for knowing and following the rules of the place you play — opening hours, permits, bookings, local by-laws. We do not check them and we do not guarantee that a court is open, exists, is free to use, or is safe.

4. Meeting people, and playing

Games arranged on Hooper happen between people who may be strangers. We do not run background checks, verify identity, or supervise anything. Use your judgement: meet in daylight or at a lit court, tell someone where you are going, and leave if you are uncomfortable.

Basketball is a physical sport. Playing it is at your own risk. Make sure you are fit to play and that the surface and rims are in a condition you are willing to use.

5. What you may not do

• Harass, threaten, bully or abuse anyone, on the app or at a game arranged through it.
• Post anything hateful, sexual, violent, or targeting people for who they are.
• Upload photographs of identifiable people without their agreement, or photographs you do not have the rights to.
• Add fake courts, deliberately wrong locations, or spam.
• Use ratings to punish someone for anything other than how they played or whether they turned up.
• Scrape the app, attack it, or try to get at data that is not yours.
• Use Hooper for anything illegal, or to advertise or sell.

6. Reporting, moderation and bans

Every player, court, photo and game can be reported from inside the app. Blocking someone hides you from each other. We review reports and may hide or delete content, remove a court, suspend an account, or close it, without notice where the situation calls for it.

A court admin may ban a player from the games organised at their court. This affects that court's games inside Hooper and nothing else — not the physical court, and not the player's use of the rest of the app.

7. Your content

What you post stays yours. By posting it, you grant us a non-exclusive, worldwide, royalty-free licence to store, display and distribute it inside Hooper, for as long as you keep it there, so that the app can show it to other players. That licence ends when you delete the content, except for copies we keep temporarily for moderation or backups.

Court information you contribute — names, descriptions, tags, locations — is shared data. It stays on the map after you leave, so that other players are not left with a court page that empties itself.

8. Levels, reliability and rankings

Levels come from other players' ratings, reliability from hosts recording attendance, and both are calculated by our servers rather than claimed by anyone. They are an estimate for matching people to games. They are not a judgement of you, and we do not promise they are accurate. Recorded attendance is final by design, so that nobody can move another player's reputation up and down at will; if a host makes a genuine mistake, contact us.

9. Availability

We offer Hooper as it is. We may change, suspend or stop any part of it. Court discovery relies on OpenStreetMap's volunteer-run servers, which we do not control and which are sometimes unavailable. We do not promise the app will be uninterrupted or error-free.

10. Ending it

You may delete your account at any time from Settings. We may suspend or close an account that breaks these terms. Sections 7, 11 and 12 survive.

11. Disclaimers

To the fullest extent the law allows, Hooper is provided “as is” and “as available”, without warranties of any kind. We specifically do not warrant the accuracy of court locations, details, availability or condition, or the conduct, identity or skill of any other user.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for injury, loss or damage arising from a game arranged through Hooper, from meeting another user, from travelling to or using a court, or from another user's conduct. Our total liability for any claim relating to Hooper is limited to the amount you paid us in the twelve months before it arose — which, for a free app, is nothing.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by our negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.

13. Governing law

These terms are governed by the laws of Spain, and disputes belong to the courts of Barcelona, Spain. If you are a consumer, you may also bring proceedings where you live.

14. Changes

If we change these terms materially we will tell you in the app before the change takes effect. Continuing to use Hooper afterwards means you accept the new version.
